Terms and Conditions of Use

0. Acceptance of the Conditions
These Terms and Conditions (hereinafter, the "Conditions") govern the access, browsing and use of the PUNTOAL website and platform, as well as the contracting and use of its services. By registering, accessing or using PUNTOAL, you declare that:
- You have read and understood these Conditions, and
- You agree to be legally bound by them.
If you do not agree with these Conditions, you must not use the Service.
PUNTOAL may update these Conditions at any time. The current versions will be available at www.puntoal.com. Continued use of the Service after any modification implies acceptance of the changes.

2. Description of the Service
PUNTOAL is an online service designed to help users manage different aspects of a business, through features that may include, among others, invoicing, quotes, orders, inventory, management and related tools.
3. Term of the Agreement
This agreement enters into force from the moment the user checks the acceptance box during the registration or contracting process.
New features, tools or improvements incorporated into the Service will be subject to these Conditions.
Failure to comply with any of the provisions contained herein may result in the suspension or cancellation of the account.
4. Account Conditions
4.1. Access requirements
- Be at least sixteen (16) years of age, and
- Have sufficient legal capacity to accept these Conditions.
4.2. Registration
Users must provide their full legal name, email address and any other information required by PUNTOAL. Users commit to providing truthful, accurate and up-to-date information.
4.3. Security and credentials
Users are responsible for maintaining the confidentiality of their credentials and for any use made from their account. PUNTOAL shall not be liable for damages or losses arising from misuse due to user negligence.
4.4. Electronic signature and acceptance
The parties agree to legally equate a handwritten signature with one made using keys, codes or other authentication and security mechanisms.
5. Contract Types, Plans and Fees
5.1. Start of contracting
Contracting a paid plan begins when the user enters their card details and makes the first payment. The limits and conditions of each plan are described at puntoal.com.
5.2. Exceeding limits
If the user exceeds the limits of the contracted plan (users, invoices, contacts, etc.), they will not be able to add more items until they upgrade or change their plan.
5.3. Fee modifications
PUNTOAL reserves the right to unilaterally modify fees. When the change affects recurring charges, PUNTOAL will notify the modification 15 days in advance.
6. Payment, Invoicing and Taxes
6.1. Payment method
To subscribe to paid plans, users must enter a valid bank card.
6.2. Recurring billing
PUNTOAL will charge in advance on a periodic basis, according to the contracted plan.
6.3. Non-refundable (general rule)
The Service is charged in advance and is non-refundable, except for the cases expressly provided for in the Refund Policy (clause 15). No refunds will be made for partial periods or non-use of the Service.
6.5. Non-payment
In the event of non-payment or charge reversal, the user will be notified and access to the Service may be suspended. Data will be retained for a maximum of 18 months.
6.6. Taxes
Fees do not include taxes or government charges. The user is responsible for their payment.
7. Service Modifications
PUNTOAL may modify, suspend or interrupt the Service temporarily or permanently for technical, security, legal, operational or business reasons, with or without prior notice, without this generating a right to compensation.
8. Cancellation and Termination
8.1. Cancellation by the user
Users can cancel their account at any time from the profile menu. Users will remain responsible for all charges up to the date of cancellation.
8.2. Deletion vs cancellation
If the account is deleted (not cancelled), its content will be removed after 30 days.
8.3. Cancellation by PUNTOAL
PUNTOAL reserves the right to cancel the account or prevent the use of the Service to users who breach these Conditions or make unlawful or abusive use of the Service.
9. Intellectual Property and Usage Restrictions
PUNTOAL is the owner or licensee of all intellectual and industrial property rights of the Service, including software, interface, design, trademark, trade name, documentation and features. The following is prohibited:
- Copying, adapting, reproducing, distributing or exploiting the Service,
- Reverse engineering, decompiling or disassembling,
- Using robots, spiders or automated mechanisms to extract or copy content.
Users retain the rights to the content they upload to the platform.
10. General Conditions and Limitation of Warranties
Users agree to use PUNTOAL in accordance with the law, good faith, public order and these Conditions. The following is prohibited:
- Reselling, duplicating or exploiting the Service without express authorization,
- Storing, hosting or sending spam,
- Transmitting viruses, worms or malicious content.
PUNTOAL does not guarantee that the Service will be uninterrupted, error-free, or meet the user's subjective expectations. To the maximum extent permitted by law, neither PUNTOAL nor its partners or suppliers shall be liable for indirect damages.
11. Security, Privacy and Data Processing Agreement
By accepting these Conditions, the parties also sign the Data Processing Agreement available within the platform. PUNTOAL will act as the Data Processor and the Client as the Data Controller.
12. Confidentiality
The parties commit to maintaining the confidentiality of all information they access within the framework of the contractual relationship. The following is considered Confidential Information:
- Client data and financial or commercial information,
- Marketing or sales plans,
- Source or object code, know-how, processes and systems,
- Designs, patents, trademarks and copyrights.
13. Usage Data and Service Improvement
PUNTOAL may collect and analyze aggregated usage data for statistical and product improvement purposes. This data will be processed in a way that does not identify natural persons.
14. Marketing Communications
By creating an account, users agree to receive promotional and marketing communications from PUNTOAL. Users may unsubscribe at any time using the "unsubscribe" link.
15. Refund Policy
15.1. Monthly subscriptions (30-day guarantee)
If the user is not satisfied during the first 30 days of use, they should contact soporte@puntoal.com. PUNTOAL will try to offer a solution and, if not possible, a full refund will be issued.
15.2. Automatic renewals
Subscriptions are automatically renewed until manually cancelled. A full refund will be issued for cancellations made within 7 business days after the automatic renewal date.
15.3. Exception
Refunds will not be accepted for users whose account has been suspended or terminated due to breach of these Conditions.

17. Applicable Law and Jurisdiction
These Conditions are governed by Spanish law. The user and PUNTOAL agree to submit to the exclusive jurisdiction of the courts of Elche, unless mandatory law provides otherwise.
18. Communications and Contact Consent
By providing personal data through registration forms, waiting lists or other means on the platform, users expressly accept and consent that PUNTOAL may contact them through the contact means provided (email, phone or other) to:
- Inform about the launch of the service and related news,
- Send commercial, promotional or informational communications about PUNTOAL products and services,
- Manage requests, queries or incidents related to the service.
This consent is free, specific, informed and unambiguous, and users may revoke it at any time by sending an email to hola@puntoal.com or using the unsubscribe link included in electronic communications.
